1. Introduction

These Terms of Service ("Terms") govern your use of the FlexForms platform and website at flexforms.co.za, operated by OrganiCode (Pty) Ltd ("we", "us", "our"), a company registered in the Republic of South Africa.

By accessing or using FlexForms, you agree to be bound by these Terms. If you do not agree, please do not use our services.

2. Service Description

FlexForms is a cloud-based form management platform that enables businesses to:

  • Design and build digital forms with dual-layout architecture (mobile capture and PDF print)
  • Send forms to recipients via email or WhatsApp with OTP-authenticated delivery
  • Capture electronic signatures
  • Generate professional PDF documents from completed forms
  • Manage contacts and track form submissions

3. Account Registration

To use FlexForms, you must register for an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Acceptable Use

You agree not to use FlexForms to:

  • Violate any applicable laws or regulations
  • Send unsolicited or spam communications
  • Collect personal information without proper consent
  • Transmit malicious software or harmful content
  • Interfere with the operation of the platform or other users' access
  • Attempt to gain unauthorised access to our systems

5. Your Obligations

As a user of FlexForms, you are responsible for:

  • Ensuring that your use of the platform complies with all applicable laws, including POPIA
  • Obtaining appropriate consent from individuals before collecting their personal information via forms
  • The accuracy and legality of all content you create and distribute through FlexForms
  • Maintaining the security of your account and notifying us immediately of any unauthorised access

6. Pricing and Payment

FlexForms offers various subscription plans as described on our Pricing page. Prices are quoted in South African Rand (ZAR) and are subject to change with reasonable notice. Free plan users may be subject to usage limits as described in the plan details.

7. Intellectual Property

All intellectual property rights in the FlexForms platform, including its design, code, branding, and documentation, belong to OrganiCode (Pty) Ltd. You retain ownership of the content and data you create and upload to the platform.

You grant us a limited licence to store, process, and display your content solely for the purpose of providing the FlexForms service to you.

8. Data Protection

We process personal information in accordance with our Privacy Policy and the Protection of Personal Information Act, 2013 (POPIA). By using FlexForms, you acknowledge and agree to the data practices described in our Privacy Policy.

9. Service Availability

We strive to maintain high availability of the FlexForms platform but do not guarantee uninterrupted access. We may perform scheduled maintenance with reasonable notice. We are not liable for any downtime or service interruptions beyond our reasonable control.

10. Limitation of Liability

To the maximum extent permitted by South African law:

  • FlexForms is provided "as is" without warranties of any kind, whether express or implied
  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
  • Our total liability shall not exceed the amount you paid for the service in the 12 months preceding the claim

11. Termination

Either party may terminate this agreement at any time. We reserve the right to suspend or terminate your account if you violate these Terms. Upon termination, your right to access FlexForms ceases, and we may delete your data after a reasonable retention period.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of the Republic of South Africa.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or a prominent notice on our website. Continued use of FlexForms after changes constitutes acceptance of the updated Terms.
